GENERAL DISCLAIMER:

VILLA UNIVERSAL.com makes an honest and diligent effort to acquire accurate information. However errors can occur. Therefore, VILLA UNIVERSAL does not guarantee the accuracy of any information available on our website, brochures, information pack and is not responsible for any omissions, errors, or misrepresentations. This website is intended to provide users with general information on matters that they find to be of interest. Whilst all the information supplied in brochures and websites is deemed to be correct to the best of our knowledge, it is understood that the information supplied is for guidance purposes only and does not form part of the contract.

Price ranges may vary with the season and number of people and may change without notice.

Our homes are on a first request basis and subject to approval. First paid, first served. For security and privacy reasons, street addresses are never given out until we confirm your reservation.

These properties are privately owned and the VILLA UNIVERSAL, its agents, employees reserve the right to refuse service to anyone at any time even if a reservation is previously confirmed. By refusing service VILLA UNIVERSAL will refund 100% of received deposit monies without interest and cancel your reservation.

We reserve the right to make any changes and update as we feel necessary.

1.                   RESERVING 2 MONTHS OR MORE PRIOR TO ARRIVAL DATE:

Once you have selected your home and checked availability, you will need to pay in full or make at least a down payment by your chosen method. Upon receipt of your funds you will receive an email/call from us acknowledging your payment and confirming your reservation. At least 12 weeks prior to your arrival the balance of rent plus refundable security deposit and payment for any optional service is due. Shortly after reception of the full rent and security deposit we will email you confirmation and contract. We will then email you direction to your home, nearby points of interest, stores, restaurants and shopping information. We will also call you with the some important to get to the house and answer any last minute queries.

2.                   RESERVING 2 MONTHS OR LESS PRIOR TO ARRIVAL DATE:

Once you have selected your home and checked availability, you will need to pay in full for the rent covering your entire stay, plus a refundable security deposit and any options if applicable. Upon receipt of your funds you will receive an email from us acknowledging your payment and confirming your reservation. Shortly after reception of the full rent and security deposit we will email you confirmation and contract. We will then email you direction to your home, nearby points of interest, stores, restaurants and shopping information. We will also call you with the some important to get to the house and answer any last minute queries.

3.                   ARRIVAL AND DEPARTURE TIMES:

Check in time is after 4 pm.  Check out time is 10 am at the latest. Any stay past each hour will be accounted a full hour. Late departures will be charged a late fee per hour up to $100.00 per hour. Early arrivals will be charged an hourly fee of $100 per hour for checking in before 4pm without prior arrangements. This is a large villa and the cleaners require adequate time to clean and make the villa ready for your stay. Late check outs will make it difficult for cleaners to finish on time and inconvenience the incoming guests.

Early check INS and late check outs can be arranged if possible, at a small fee.

If the villa was left in an inconsiderate mess or if there are events beyond our control, it is possible that the villa may not be ready for your arrival at 4 pm. This is not the norm but in the unlikely event that this happens, please leave the villa until such time as the cleaning crew have finished. Entering the villa or leaving the luggage in the villa while the cleaning crew are present will result in the cleaning crew leaving the villa without finishing the job. The cleaners will not work with guests or luggage present.  If you enter while the crew are present, you will then be responsible for completing the clean. No refunds or compensation will be provided if there is unavoidable delay in check in or if the cleaning process is interrupted.

4.                   PERSONAL AMENITIES:

All our homes include linen and towels. Face cloths, kitchen towels and beach towels are not provided. There will be minimal supply of toilet tissue and other cleaning products and once these have been depleted, you will need to provide your own.

5.                   PHONE, INTERNET, CABLE TV:

Phones are provided offering unlimited FREE local access only. We are aware how important a telephone is to you and we recommend that you bring with you your own cell phone or your long distance calling card. All our homes are equipped with internet access (PC provided) and wireless access.  NO TECHNICAL SUPPORT IS PROVIDED. “AS-IS” without warranty whatsoever. You assume all risks and responsibilities for use of the network. VILLA UNIVERSAL makes no warranty that the network will be error free or free from interruption or failure or that it is compatible with any particular hardware or software, to the maximum extent permitted by applicable law. VILLA UNIVERSAL DISCLAIMS ALL WARRANTIES, EITHER Express OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES, FITNESS FOR A PARTICULAR PURPOSE. YOU HEREBY ACKNOWLEDGE THAT THE NETWORK MAY NOT BE AVAILABLE OR BECOME UNAVAILABLE DUETO ANYNUMBER OF FACTORS INCLUDING, WITHOUT LIMITATION, PERIODIC SYSTEM MAINTENANCE, SHEDULED OR UNSCHEDULED, ACTS OF GOD, TECHNICAL FAILURE OF THE SOFTWARE, TELECOMMUNICTIONS, INFRASTRUCTURES, OR DELAY OR DISRUPTION ATTRIBUTABLE TO VIRUSES, DENIAL OF SERVICE ATTACKS, INCREASED OR FLUCTUATIONG DEMAND, ACTIONS AND OMISSIONS OF THRID PARTIES OR ANY OTHER CAUSE RESONABLY BEYOND THE CONTROL OF VILLA UNIVERSAL. YOU ASSUME THE ENTIRE COST OF ANY DAMAGE RESULTING FROM YOUR USE OF THE NETWROK AND THE INFORMATION ACCESSED BY THE NETWORK AND THE INTERACTION (OR FAILURE TO INTERACT PROPERLY) WITH ANY OTHER HARDWARE OR SOFWARE WHETHER PROVIDED BY THE OWNER OR A THRID PARTY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN NO EVENT WILL VILLA UNIVERSAL BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INERRUPTION, LOSS OF BUSINESS INFORMATION, LOSS OF COSTS, TIME VALUE OR OTHER PECNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE NETWORK OR THE INCOMPATIBILITY OF THE NEWTWORK WITH ANY HARDWARE, SOFTWARE, OR USAGE. THE INFECTION OR DOWNLOAD OR UPLOAD OF OR BY ANY VIRUS, SPYAWARE, WORM, OFENSIVE MATERIALS, COPYRIGH T INFRINGEMENT, UNLAWFUL USE, OR ANY OTHER USE RELATED DAMAGE EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

COPYRIGHT INFRINGEMENT IS UNLAWFUL AND SHOULD NOT BE CARRIED OUT IN THE VILLA. THIS WILL RESULT IN FOREFITURE OF THE DEPOSIT AND POSSIBLE LAW SUIT.

In the event that the property has no internet access and or cable, power or gas outage, VILLA UNIVERSAL shall not be liable or be responsible for 3rd part companies’ failures and or servers down during your stay.

In the event that you plug your own devices into any TV sets during your stay, we ask that prior to your departure all original connections are plugged back exact same way and all TV DVD to be operational from the on and off remote switch as found upon your arrival. Failure to do so will result in Tech fees which could rise up to $250.00 and shall be deducted from your deposit.

6.                   SMOKING:

For the safety and comfort of all our guests smoking is not permitted within the property or on the pool deck. Throwing cigarette butts on the premises poses a fire hazard. If the no smoking rules are not respected and butts are found on the property or the pool deck, this will result in immediate eviction with no refund and complete forfeiture of your security deposit. Thank-you.

7.                   PETS ARE NOT PERMITTED:

Undisclosed pets will cause full forfeiture of your security deposit and immediate eviction.

8.                   UTILITIES:

In most circumstances, all utilities are included in the rental price. Expenses over $100 per week per utility will be considered excessive and will be charged to the guest. Please make efforts to conserve energy by turning off unused lights, games, TVs etc.

Gas, water and power will be charged for rentals over one month. If applicable any amounts for gas, water or electricity shall be paid upon request or be subtracted from your security deposit.

9.                   TRASH:

The trash is collected on Thursday mornings by automatic collection trucks. Trash that is not bagged will not be picked up. There are two trash cans provided and only one can should be used during your stay. One can must be left empty for the next guest to use. Trash in both trash cans on check out will result in one being emptied for the new guests and this will be charged to you. Trash allocation is one trash can (supplied by county) and one recycle box and this will be emptied on Thursday morning. Excess trash left at the property will be removed and taken to the yard and this charge will be passed to you. Un-bagged trash, overflowing trash can, or garbage found in places other than city trash can result in also result in forfeiture of your security deposit.

10.               POOL HEATING:

Pool heating is optional and additional to the rent due. If you wish to have a warm pool on your arrival, pool heating fees start the moment we start the heater, which may be one or two days prior to arrival date.

Pool heating fees must be paid in advance prior to arrival date and are non refundable. If you decide to heat the pool during your stay you may be charged extra call trip fee in addition to pool heating fees.

In the event pool heating is requested and paid for, VILLA UNIVERSAL cannot guarantee the temperature of the pool as this will vary according to different factors, predominantly the weather conditions at the time. The owner or owner's agent will not be held responsible for any electrical or mechanical failure of pool heating equipment.

The spa is relaxing with hydrotherapy jets but please note that the spa water will be the same temperature as the pool water.

Algae spores are found in the atmosphere and in the summer months it is possible for the pool to become overgrown with this within a matter of hours, when the conditions are right for growth. With global warming, this is becoming an increasing problem. If this happens, the management company need to be informed and they will take the necessary measures to remove this from the pool. It may take several days to kill the algae and for it to be filtered out. Although algae are not harmful to swimmers, it can be an inconvenience. If this happens during your stay, action will be taken to rectify the situation but no refunds or compensation will be provided.

Any guest interference of pool pump, heater or equipment, draining of pool etc will be deemed as criminal damage. The Sheriff will be called and eviction will be carried out, the security deposit will also be forfeited.  Further legal action may follow also.

11.               SPECIAL EVENTS:

Large parties, weddings events and commercial filming and or photo shoots of any kind are strictly forbidden without written approval. Failure to comply will cause immediate eviction and a full forfeiture of your security deposit plus any additional expenses caused by utilities usage and or damages (if any).

12.               SECURITY DEPOSIT:

Upon signing the rental agreement the signatory agrees to pay for any damage of any kind to the property and company from the security deposit. It is requested for any unforeseen damages, missing items or property belongings, unreasonable cleaning or unpaid fees including extension of rental stay. Security deposits will be refunded minus deductions (if any). Damages requiring professional repairs may delay timely refunds and additional maintenance fees may apply.

We retain the right to retain the security deposit (in part or full) to cover breakages, damage or non return of key.

Barbecue if used must be left clean or a cleaning fee will be deducted from deposit for maintenance man to clean. All damages or faults found at the home must be reported to the management company at the earliest opportunity. The home inventory is checked before and after your stay and any faults reported may result in additional cleaning/ replacement charges e.g. spills, stains etc.

This deposit is fully refundable after your departure from the property, providing there are no claims made against it, within 30 days (or earlier) of your departure. In the event of any excess damage of any kind to the property or excess cleaning costs or excessive use of utility- water, gas, electricity (e.g. leaving external doors open with air conditioning on) which exceed the security deposit, the signatory will be held responsible for all additional costs. We reserve the right to pursue a guest for recompense for any and all damages caused which may exceed the value of the security deposit, within 14 days of being served notice of this.

Any rental for more than four weeks require a minimum refundable security deposit equal to two (2) weeks rent. Higher security deposits may be required for special events.  Security deposit will be issued by US cheque or wire transfer (UK). Wire/ PayPal/ Accounting fees may apply.

13.               CLEANING:

All our homes are professionally cleaned prior to your arrival and upon your departure. A cleaning service is employed by the management company and is a mandatory part of the rental. This is included for stays of 7 nights or more.  There is a separate cleaning fee assessed for stays of less than 7 nights. The departure cleaning fee is for normal reasonable cleaning; however, if extra unreasonable cleaning is required due to the property not being left in satisfactory condition, then an extra amount will be deducted from your security deposit.

Overload of laundry at your departure may but us in a bind for our next renters checking in the same day, therefore you are expected to wash and dry yourself, any excess any sheets and towels used during your stay with the exception of sheets for the exact number of beds in the home and two towels per bathroom.  Dishes and cooking utensils must be rinsed and placed in the dishwasher. Failure to do so may result in additional charges and or full forfeiture of security deposit.

No cleaning service is provided during your stay unless by prior arrangement. If you require deep cleaning prior to your stay, please contact us and we may be able to arrange this for you at a small additional fee, time permitting.

14.               PARKING:

There is ample parking on the driveway and on the streets.  Parking on the grass/ lawn in prohibited. This can result in sprinkler head being broken and hefty water charges which can result in loss of security deposit.

15.               CODE OF CONDUCT:

The villa is located in a residential community. Nothing should interfere with the quiet enjoyment of other holidaymakers and residents. It is a violation by city ordinance to play loud music, or do anything else which is likely to inconvenience your neighbours after 22.30pm or before 7.30am.

Use of recreational drugs is strictly prohibited. The premises shall not be used for any illegal or unlawful purposes. Downloading of copyrighted material (copyright infringement) is illegal.

Failure to respect this code of conduct will result in immediate eviction and forfeiture of your deposit.   

16.               BOOKING CANCELLATIONS, FOREFEITURE AND RESHEDULING:

For reservations made two months or more prior to arrival date, no reminders will be sent and it is the guest’s sole responsibility to pay all fees due in a timely fashion. If full payment is not received at the appropriate time this will be considered as forfeiture.

If you cancel 90 days or more prior to your reserved dates and after you have already paid the rental down payment, we will refund your money without interests less an administration fee of up to $250, only if we are able to re rent the property for the same time period within 30 days after we received notice of your cancellation. Security deposits will be refunded without interest minus banking fees and less any accounting fee up to $100.00. Any other cancellation made after 90 days or less prior to arrival dates will result in loss of reservation and 100% of rental fee plus bank and administration charges. Security deposit will be refunded minus banking fees and less accounting fees.

Rescheduling is subject to availability and at our discretion. Reschedules occurring from a higher rental rate to a lower rental rate will remain at the higher rental rate.  Reschedules occurring from a lower rental rate to a higher rental rate will need the difference to be met. A $250.00 administrative fee applies to all reschedules of the reservation. This fee is due 90 days before the beginning of the rescheduled rental period and if not received, triggers forfeiture as above. Only one reschedule permitted per guest.

It is the responsibility of the signatory to ensure the signed cancellation letter reaches VILLA UNIVERSAL. E-mail cancellations are not acceptable. A cancellation fee may apply.

If for any reason VILLA UNIVERSAL discovers that the home you rented is not rent-able upon your arrival due to unexpected last minute maintenance needed in the house or any other reasons, we shall then put our best efforts to relocate you in a different house of similar calibre, however, VILLA UNIVERSAL cannot guarantee relocation. Once we have offered you relocation, your signed agreement related to your original reservation and the entire content of this disclaimer shall be in effect and no refund or compensation shall be due. VILLA UNIVERSAL , its employee's agents or representatives shall not be held responsible for any damages and or liable for relocating you to a different home that your original reservation. In the event we are unable to relocate you, we shall inform you and we shall refund you any monies you prepaid, excluding any postal charges, wire fees, PayPal fees etc. in any case, no damage and or responsibilities and or liabilities shall be against VILLA UNIVERSAL  for not honouring your original reservation.

17.               RESPONSIBLE ADULTS:

This property is rented with the understanding that you will leave it at check out in the same condition as you checked in.

Children must at all times be supervised by responsible adults when using the swimming pool and at no time should children be left unsupervised without the pool safety fence being properly in place and that children must be  supervised in the pool area at all times. Glass is not permitted within the pool area. Plastic glasses are provided.

The guests are responsible for the property, and are expected to take all reasonable care of it including the locking of all doors and windows and ensuring the security alarm is activated whenever the house is unoccupied. The security alarm must be activated each time the villa is left unoccupied, and patio blinds must be closed.

Rentals are to families and responsible adults only. No bachelor parties, holiday parties or other large parties beyond that which is pre arranged with VILLA UNIVERSAL. Properties are patrolled on a regular basis. The guest acknowledges that he/she will personally occupy the property for the entire period and will not sublet any portion of any property.

Persons under 21 years of age are not accepted unless accompanied by parents or responsible adults or by prior agreement with VILLA UNIVERSAL. This property is fully licensed for short-term rental in Florida. VILLA UNIVERSAL reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.

The accommodation cannot be shared; assigned or sublet and only persons shown on the reservation form are permitted to stay in the property.

18.               FIRST TIME RENTERS:

If you are new to renting a self catering home for your vacation, it can be daunting at first. It is a very full filling and exciting experience and many repeat this every year. However, there are a few differences between hotel accommodation and a self catering villa.  The main difference is of course the difference in price of the stay and secondly the lack of 24 hour staff to wait on you. Villa has an excellent Management service which can be contacted during office hours for maintenance calls and out of hours in emergencies, 365 days of the year.

As a working villa things may breakdown or malfunction, unlikely but possible. When this happens, the management company will schedule workmen to come and repair or for item to be removed, as practicable. Please do not expect that it will be possible to fix it the moment you mention it, as they might be able to do in a hotel.

Deep cleans are done periodically. The villa is cleaned by professionals between guests to an accepted high standard.  Additional or deep clean is optional and can be done on request, subject to availability and time and there may be charge for this service.  

Please do not be alarmed by the possibility of deductions from the security deposit. These are not for wear and tear. There will be certain amount of wear and tear before you arrive and after you leave. The management company are aware of the state wear and tear at the home. However, if you find significant damage or something broken, then let the management company know at the earliest opportunity and you will not be held responsible for this. This is our home and all we expect it that you treat it with respect, feel free to relax and enjoy it like your own during your stay

The villa is the owner’s home and decorated to owners taste. The photos of the villa are taken recently. Please view the accommodation, view the virtual tour and ask us if you have any questions. It is necessary for us to change things from time to time and if something is important to you, ask us! We are here to help you and make this a pleasant experience as possible!

19.               MAXIMUM OCCUPANCY:

The names, ages and occupations of all persons occupying the villa must be listed on the reservation form. This must include small children and infants.  This is mandatory requirement and must be adhered to. Due to State Fire Regulations under no circumstances may more than the named number of persons identified on the Booking form occupy the property.

Once a reservation is made and agreed, guests can be added in agreement with VILLA UNIVERSAL but may incur additional costs. 10% per person over occupancy charge to the absolute number below. Absolute maximum occupancy at any time in the villa is 14 for 6 bedroom villa and 12 for 5 bedroom villa.

Undisclosed names and number of guests at time of reservation will result in immediate eviction with no refunds and forfeiture of your security deposit. Violation of any of this shall give rise to immediate eviction with no refunds and forfeiture of security deposit.

20.               FURNISHING:

All properties are equipped and furnished to the owners taste and are set up for light housekeeping. Mattress protectors and pillow protectors are used for hygiene reasons and should not be removed.

Rearrangement of furniture is not permitted. Any items or objects moved, cleared or misplaced including but not limited to pool deck, indoor or outdoor areas, change of TV source or electronic devices not found at its original place on the property at the time of departure will be charged a minimum fee of $250.00 or more.

 

21.               EXTRAS (APPLIANCES):

Televisions, DVD players, pool, spa, washer, dryer, internet, etc herein called ‘extras’ are supplied at no extra charge as a convenience for guests to use. In the event of a malfunction or breakdown of ‘extras’ management will have these repaired as quickly as practical. Guest agrees there will be no refund, for the malfunction or breakdown of ‘extras’. In the event of malfunction of any other appliance or feature, guest must notify the management so repair of malfunction can be made. We will expedite repair but no refund of rent or recompense will be made. Furthermore, VILLA UNIVERSAL cannot guarantee that all the amenities and facilities described will be available.

Don’t rewire, unplug, change settings, reprogram, or reset/modify any of the appliances/ water heaters. Do not attempt to connect any video games computers, or other electronic equipment, to the TVs, networking equipment or other appliance. Any repair work, rewiring settings reset or reprogramming will result in this being charged to the guest.

22.               GAMES/BOOKS/DVDS:

Games are not provided for Guests. These can be locally bought or please feel free to bring your own. There may be some games, DVDs and books in the villa- the appropriateness and quality of these are not checked and must be the guests’ responsibility to check that these are appropriate for the children.

23.               WEATHER:

No representations or warrantees are made with respect to any weather conditions at all including any natural disaster conditions. Guest agrees to comply with instructions from management and any advisory statement from any local emergency authorities in a natural disaster situation.  No refunds or compensation are given for any weather condition.

24.               ABANDONED ARTICLES:

VILLA UNIVERSAL shall not have any responsibility for lost, stolen or abandoned items. There will be a $25 plus shipping fee for any returned items. It is the guest’s responsibility to make sure all your property is removed at the time of departure.

25.               MAINTENANCE:

Maintenance will be available ONLY for major vital maintenance and living repairs emergencies of the rental premises not due to the renters misuse, waste or neglect or that of his employee, family friend or agent or visitor. VILLA UNIVERSAL cannot guaranty that minor maintenance not considered as an emergency will be performed during your stay. Maintenance calls are only available during business hours and not available on Saturdays, Sundays and or Holidays, unless it is an emergency. You are responsible to be present during any repairs and or maintenance performed. Maintenance and repairs do not include clogged pipes from sinks and or toilets which shall be your sole responsibility at your own expense.

26.               GUEST INITIATED MAINTENACE CALL:

Should the manager be required to visit the property other than on regular patrol, for example on request of guest for use of property or ‘Extra” instruction, or property repair which was a result of guest action or misuse, a $150.00 maintenance call fee will be charged. Maintenance issues which are not the fault of the guest are excluded from this charge however the final determination of the nature of a visit is with the property manager.

27.               INDEMNITY:

The guest agrees to release and indemnify the from and against all liability should anyone be injured upon the premises during the term of the lease, resulting from any cause otherwise, incurred or suffered upon the premises by tenant and guests or any associated with tenant for any cause whatever during the term of this contract. Guest’s personal property and vehicles are not insured by the owner or owner’s representatives against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others or any other cause. 

28.               OWNERS AREAS:

Areas such as the personal storage areas are exempt from this lease and are off limits to the guests. Entry into these areas is cause for immediate eviction and guest will be responsible for any damages or missing items.

29.               WATER:

Please conserve and be careful in water usage to help us practice responsible conservation.

30.               ANY EXTENSION OF STAY:

Any extension of stay following pre- agreed dates is considered enforceable and cannot be cancelled later due to the fact VILLA UNIVERSAL will immediately take the property off the market and reserve the property (if available) and therefore all fees must be paid in advance or VILLA UNIVERSAL reserve the right to deduct payment from the security deposit in order to cover additional rental nights.

31.               PAYMENT:

Payment by wire transfer, direct deposit, cashiers or bank cheque is accepted. Any cheque returned unpaid by the bank (stop payment or NSF) will result in an NSF charge of 3 times the amount written on the cheque plus a minimum fee of $250.00. Credit card, debit card and e-cheque payments are accepted via PayPal (payment via this method will invalidate the direct payment discount). 

A minimum reservation amount is required, together with a completed reservation form and signed contract to make the reservation.

32.               FAUNA AND FLORA: 

Florida has a sub tropical climate and care must be taken with food that is left uncovered. Spoiling and contaminating food left uncovered can attract insects very quickly. Any added costs for pest control services incurred from lack of care in this, may be passed to you.

It is important to keep the windows and doors closed when not in use as this can allow the entrance of small bugs

Home owners are not liable or responsible for any wild animals, insects entering the rental property during your stay including but not limited to ants, bees, flies, etc. 

33.               REFUNDS:

Every effort is made to maintain the rental property in good order, it should be noted that wear and tear of rental properties is unavoidable. For this reason, damaged furnishings may be replaced and occasionally, swimming pools, appliances in the home, toilets and utilities my need repair. Furthermore, VILLA UNIVERSAL cannot guarantee that all the facilities described in the promotional literature will be available. It may take time to engage a worker and or obtain parts and your patience is appreciated during this process.

If in the unlikely event that you have cause to complain or have a problem with any aspect of the accommodation during your stay, you should in the first instance contact the property manager, within 24 hours. The property manager will make every effort to resolve any complaint/problem that you may have. The Guests must allow the property manager sufficient time to remedy the problem. Vacating the rental property without authorisation does not constitute sufficient cause for a refund.

Any complaint not reported to the property manager at the time the problem occurs but only reported after the Guest return home will not be considered... Failure to give notice of a complaint when it occurs during the rental period and or failure to remain in contact with the property manager, providing access, during the rental period will void any complaint following the rental period and no remedies will be offered.

Although every effort will be made to correct any problems that arise during your stay, there will be no refunds for mechanical failure of non essential items such as air conditioner, fridge, TV, DVD grills, games and equipment, fans, deck furniture, dishwashers, washer dryers, range, spa, coffee machine, blender, microwave or other items and appliances VILLA UNIVERSAL cannot be held responsible for any temporary defect or malfunction of any appliance, equipment or machinery in the building, grounds or swimming pool.

 The vast majority guests of VILLA UNIVERSAL  guests derive great pleasure from the rental. If something does go wrong, please follow instructions above and make appropriate allowance for remedy. Failure to comply with the above provisions and or to accept the good faith remedies offered during the rental period will void any consideration following the rental period.  As we have been deprived of the opportunity to investigate and rectify the problems.

34.               WEBSITE AND OTHER ADVERTISEMENTS:

This website or any other on-line, paper verbal, or other forms of materials describing the property are NOT part of this rental agreement and there is an acknowledgement that any representations those materials have made with respect to the property were for informational purpose only and have no bearing or obligation with respect to completeness or correctness regarding the property.

35.               COPY RIGHT:

All content on this website including, but not limited to logos, graphics, text, button, icons and images is the property of VILLA UNIVERSAL and cannot be reproduced and is protected by U.S. and International copyright laws.

36.               LIABILITY:

VILLA UNIVERSAL and management Company of the property accept no responsibility whatsoever for the death, personal injury, accidents, loss, or damage to persons or personal belongings however caused. The use of all accommodations and all amenities, including the swimming pool and spa is entirely at the users own risk.

37.               INSURANCE:

VILLA UNIVERSAL and Management Company cannot accept any liability for any loss of rental time due to travel problems, flight delays, cancellations, terrorist acts, industrial disputes or any events, which are outside our control, including any form of Force Majeure.

It is a condition of this booking that all members of the party are covered by travel insurance, which carries adequate protection against delays and cancellation, and has adequate medical insurance for the USA and for your luggage and personal belongings.

38.               LAW:

This contract is subject to and shall be construed in accordance with the laws of England and all parties hereby submit to the exclusive jurisdiction of the English Courts.

This entire disclaimer including all terms and conditions within shall be part of our invoices and rental agreement and valid in the absence of signature from VILLA UNIVERSAL.
